I would opt for the bird being upright instead of upside down being the literalist that I am :)And I love the colors!

what an interesting coincidence...yesterday in my visual/poetry crit, i showed my woodpecker picture alongside my poem of the same name. in my mind, displaying it upside down made sense. the audience was split 50/50 on that flip, and i decided instead to go with a black & white that I also flipped but that doesn't look as surreal.
for you, i'd say go with the upside down one.
good, good colors, i concur.
